As of 25.05.2018, Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, also known as the General Data Protection Regulation (GDPR), becomes applicable.
What are personal data?
Personal data is any information that relates to an identified or identifiable individual. Different information which, together, can lead to the identification of a particular person is also personal data. Personal data that have been anonymized, encrypted or pseudonymous but can be used to re-identify a person remain personal and are targeted by GDPR. Personal data that have been made anonymous in such a way that the individual is not or is no longer identifiable is no longer considered to be personal data. For the data to be truly anonymous, the anonymisation must be irreversible.
The GDPR protects personal data irrespective of the technology used for processing the data – it is “technologically neutral” and applies to both automatic processing and manual processing, provided data is organized according to predefined criteria (for example, in alphabetical order). It also does not matter how data is stored – in an ICT system, video surveillance or paper; in all these cases, personal data are subject to the protection requirements of the GDPR.
